The Legal Issues

The following documents should be attached with the contract:

- A copy of the buyer's passport
- Two recent pictures of the buyer
- A copy of the permit for the erection of the project
- A copy of the registration record of the company
- A copy of the title deed which later will be transferred to the new owner
- Copies of all the company's documents, such as the permit for establishing the company, the company's record at the chamber of commerce, and a copy of the company's activities.

The real estate registration to the new owner usually takes between 45 to 60 days. This much time is needed because the Military Department of the Ministry of Defense, located in Ankara, will investigate into the company's application to get the real estate ownership transferred to the buyer. They will investigate that the real estate isn't in restricted areas for foreigners or whether anything will compose a threat to the Turkish national security.
In the interval, the buyer can prepare and transfer the amount of money from abroad to his own account in Turkey, where it will be transferred later to the company's account upon receiving his/her title deed. Upon receiving the approval of the Military Department and upon completing all the procedures with the authorities, the buyer or his representative will be summoned to Turkey where he/she should be present in no more than 15 days, in order to receive the title deed along with the keys. The buyer then will pay the full amount to the construction company. The title deed will be handed to the buyer at the cadastre with the presence of a sworn and authorized translator who will give the buyer some clear information in English about the purchased real estate. After that, the title deed will be officially given to the buyer by the assigned clerk at the cadastre, not at the notary public as it is the case in European Union countries.
It should be noted that if the buyer, for any reason, couldn't make it on time to Turkey, he/she could send a representative to sign the contract and to complete the first stage of the purchase process. Later on, the buyer can also authorize a person to receive the title deed. However, the authorized person needs a written authorization which should be signed and sealed by the notary public in the buyer's country of origin. This written authorization, moreover, should be verified and translated into the Turkish language at the Turkish embassy of the buyer's country of origin.

Fees & Taxes

Fees for translating and certificating the buyer's passport: $100
Fees for obtaining the title deed: $90
A 3.9 % tax of the total value for owning a real estate in Turkey.
Note that this tax of ownership is paid only once upon the receiving of the title deed. It's NOT annual.
Fees for the sworn translator: $100
Fees for the application of the real estate transfer. Payable to Maps Department at the cadastre: $200
A 0.03% tax of the value of the real estate as annual fees for the municipality Payable in May of each year at the municipality hall of the city
These fees are for civil planning of the municipality.
